Commercial Terms and Conditions
I. DEFINITIONS & INTERPRETATIONS
1.1. In these conditions, the following words and phrases shall have the meanings ascribed to them below:
1.1.1. “Customers” means the person or party who purchases the Products form Seller.
1.1.2. “Seller” means HúsDeco (HDI ehf., kennitala 651022-0290) whose registered office is at Desjamýri 11V, Mosfellsbær, Iceland trading www.husdeco.is.
1.1.3. “Contract” means any contract between the Seller and the Customer for the sale and purchase of the Products, subject to and incorporating these conditions.
1.1.4. “Products” means any Products agreed in the Contract to be supplied to the Customer by the Seller (including any part or parts of them)
1.2. A reference to a particular law is a reference to it as is in force for the time being taking account of any amendment, extension, application, or re-enactment and includes any subordinate legislation for the time being in force made under it.
1.3. Words in the singular include the plural and the plural include the singular.
1.4. A reference to one gender includes a reference to the other gender.
1.5. Conditions headings do not affect the interpretation of these conditions.
II. ORDER PROCESS
2.1. All orders placed by the Customer are subject to final acceptance by the Seller.
2.2. Following receipt of any order, the Seller may send to the Customer an order acknowledgement detailing the Products which have been ordered. This communication is not an order confirmation or order acceptance from the Seller.
2.3. Acceptance of the Customers order, and the completion of the Contract between the Seller and Customer will take place on making prepayment in value of 100% of the ordered items.
III. DESCRIPTION AND PRICING
3.1. The description of the Products shall be as set out the Seller’s website at the time the Customer places and order.
3.2. All samples, drawings, descriptive matter, specifications, and advertising issued by the Seller and any descriptions or illustrations contained in the Seller’s website are issued or published for the sole purpose of giving an approximate idea of the Products described in them. They shall not form part of Contract which is not a sale by sample.
3.3. Every effort is made by the Seller to ensure that prices shown on the Seller’s website are accurate. If an error is found, the Supplier will inform Customer as soon as possible and offer the option of reconfirming the order at the correct price or cancelling the order.
3.4. All prices are shown in ISK (Icelandic krone) and include taxes and shipping to Iceland but exclude delivery charges to home address. Items can be picked up by a Customer from Seller’s warehouse or, at additional charge, delivery to specified address.
IV. DELIVERY
4.1. Delivery of the Products shall be made:
4.1.1. At additional charge, to the Customer address.
4.1.2. At the Seller’s sole discretion, to any address specified by the Customer.
4.1.3. Or by the Customer collecting Products at the Seller’s premises at any time after the Seller has notified the Customer that the Products are ready for collection.
4.2. The Customer acknowledges that it may be required by the Seller to provide address and prior to delivery being made.
4.3. Any dates specified by the Seller for delivery of the Products are intended to be an estimate. The average order processing takes between 6-12 weeks. The Seller makes every effort to deliver furniture in timely manner, however, cannot guarantee any specific deadlines.
V. PAYMENT
5.1. Payment for the Products by the Customer can be made by transfer, online card payment (visa or mastercard) or installments by SaltPay.
5.2. The order must be paid within 2 days, otherwise it will be cancelled.
VI. CUSTOMERS RIGHT OF CANCELLATION
6.1. Furniture is produced and imported to Iceland upon Customer’s order. Therefore, orders cannot be cancelled after the producer starts manufacturing it. In case of the order’s cancellation, the Seller reserves the right to keep the deposit.
VII. UNFORESEEABLE DELAYS
7.1. The Seller reserves the right to defer the date of the delivery or to cancel the Contract or reduce the volume of the Products ordered by the Customer (without liability to the Customer) if it is prevented from or delayed in the carrying on of its business due to circumstances beyond the reasonable control of the Seller including, without limitation, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labor disputes (whether or not relating to either party’s workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, provided that, if the event in question continues for a continuous period in excess of 90 days, the Customer shall be entitled to give notice in writing to the Seller to terminate the Contract.
VIII. QUALITY
8.1. The Seller is a reseller and not a manufacturer of the Products.
8.2. Products which are found to be defective following delivery shall be replaced by the Seller.
IX. RETURNS
9.1. No returns will be accepted for goods shipped to Iceland.
